Remaining Relative visa for Australia

Remaining Relative Visa (subclass 115 and subclass 835)

This visa is for you if your entire family is living permanently in Australia and you have no close relatives outside of Australia.

You must have no brothers, sisters or parents living outside of Australia. If you are married or have a defacto partner, the spouse must also not have any brothers, sisters or parents living outside of Australia.

You may not be eligible for this visa if your sponsor has been granted a visa for or successfully sponsored someone for:

    • Remaining Relative visa subclass 835
    • Remaining Relative visa subclass 115
    • Preferential Family visa subclass 104 (now closed to new applicants)
    • Family visa subclass 806 (now closed to new applicants)

Similarly, you will not be eligible for this visa if you or your partner have any near relatives, who are usually living outside of Australia, or only living in Australia on a temporary visa, bridging visa or unlawfully.

You must also meet the health and character requirements and have no outstanding debt to the Australian government or have arranged to repay any outstanding debts to the Australian government before the visa is granted.

Your sponsor for the Remaining Relative visa must be:

    • Your parent, brother, sister, stepbrother or stepsister or one of their partners (This includes half and step-relatives and relatives that have been adopted).
    • 18 years old or older
    • Settled in Australia
    • An Australian citizen, permanent resident or eligible New Zealandcitizen.

The sponsor also must agree to provide you with accommodation, support and financial assistance for the first 2 years of your residency in Australia.

One of the requirements for the visa approval is to provide an assurance of support and this is required in all cases.

Due to the low number of places available in the migration program for this type of visa, waiting times may be very long.
